Article 1: General Provisions

The e-commerce website of Ybe Casteleyn, a one-man business with its registered office in 1150 Brussels, Belgium, Meiklokjeslaan 18/2, VAT BE 0881014079 (hereinafter "Ybe Casteleyn") offers its customers the opportunity to purchase the products and services from its online store online.

These General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via Ybe Casteleyn's webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Ybe Casteleyn.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and any other taxes or duties that the Customer is obliged to pay.

If delivery, reservation or administrative fees are charged, this will be stated separately.

The statement of price refers only to the items as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Ybe Casteleyn. As far as the correctness and completeness of the information offered is concerned, Ybe Casteleyn is only bound by an obligation of means. Ybe Casteleyn is in no case liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, as far as products are concerned, we request the Customer to contact us in advance.

The offer is always valid while stocks last and may be modified or withdrawn by Ybe Casteleyn at any time. Ybe Casteleyn cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online Purchases

Through the website www.ybecasteleyn.be, online training, supervision and other similar online services can be purchased. In addition, psycho-educational educational materials are offered.

The Customer can place an order for these services and/or products through the website www.ybecasteleyn.be and pay for them directly online. The Customer has the choice between the following payment methods:

  • by credit card
  • by bank card (Bancontact)
  • via I-deal
  • by bank transfer

Ybe Casteleyn is entitled to refuse an order pursuant to a serious failure on the part of the Customer with respect to orders involving the Customer.

Article 5: Delivery and execution of the agreement

After registration and payment for the services mentioned in article 4 of this agreement, the buyer will receive a confirmation via email. He/she will be invited to the online training, supervision or similar service mentioned in article 4 of this agreement through an electronic media platform.

Items ordered through this web store are delivered to all countries. For Belgium and the Netherlands the delivery costs are mentioned on the website. For all other countries, additional information about the delivery costs of products is given to the buyer by Ybe Casteleyn.

Unless otherwise agreed or expressly stipulated, goods shall be delivered to the Customer's place of residence within 30 days of receipt of the order. Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to Ybe Casteleyn without delay.

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by Ybe Casteleyn.

Article 6: Retention of title

The items delivered remain the exclusive property of Ybe Casteleyn until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to draw the attention of third parties to Ybe Casteleyn's retention of title, e.g. to anyone who might come to seize items that have not yet been paid for in full.

Article 7: Right of withdrawal and cancellation

The provisions of this article apply only to Customers who purchase items online from Ybe Casteleyn in their capacity as consumers.

The Customer has the right to revoke the agreement within a period of 14 calendar days after ordering and paying for the services and/or products mentioned in Article 4 of this agreement without giving reasons.

The withdrawal period expires 14 calendar days after the day of order and payment by the customer of a service and/or product mentioned in Article 4 of this Agreement.

To exercise the right of withdrawal, the Customer must inform Ybe Casteleyn, Boulevard de la Meiklokjeslaan 18/2, 1150 Brussels, Belgium; team@ybecasteleyn.be of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Ybe Casteleyn, Avenue de la Meiklokjeslaan 18/2, 1150 Brussels, Belgium, without delay, but in any event no later than 14 calendar days after the day on which he communicates his decision to withdraw from the contract to Ybe Casteleyn. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer If the returned product is somehow diminished in value, Ybe Casteleyn reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items in their original packaging, along with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer has requested that the performance of services begin during the withdrawal period, the Customer shall pay an amount proportional to what has already been delivered at the time he has notified us that he is withdrawing from the contract, compared to the full performance of the contract."

If the customer revokes the contract within the legal deadline, as mentioned here in article 7 of this contract, Ybe Casteleyn will refund all payments received from the customer up to that point, including standard delivery costs (in the case of delivered products), to the customer within a maximum of 14 calendar days after Ybe Casteleyn has been informed of the customer's decision to revoke the contract. In the case of sales contracts for the products ordered by the customer on the www.ybecasteleyn.be website, Ybe Casteleyn may wait to refund until it has received all the goods back, or until the customer has proved that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Ybe Casteleyn shall not be refunded.

Ybe Casteleyn will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refunds.

  • The Customer may not exercise the right of withdrawal for: service contracts after full performance of the service [if performance has begun with the Customer's express prior consent, and provided the Customer has acknowledged that he loses his right of withdrawal once the contract has been fully performed];

When canceling the services mentioned in this agreement in Article 4, namely: online training, online supervision and similar online services, in addition to the statutory right of withdrawal, the following rules apply:

  • in case of cancellation of the above mentioned services (after the 14-day period of the legal right of withdrawal) counted from the 1st day after the 14-day period of the legal right of withdrawal until 30 calendar days prior to the 1st day of the online training, - supervision or similar online service ordered by the Customer, administration and processing costs will be charged to the Customer of euro 50,- (in words: fifty euros).
  • no refunds will be made for cancellations within 30 calendar days prior to the 1st day of the online training, - supervision or similar online service ordered by the Customer.

Article 8: Customer service

Article 9: Penalties for non-payment.

Without prejudice to the exercise of other rights available to Ybe Casteleyn, in the event of non-payment or late payment, the Customer shall automatically and without warning owe interest of 10% per year on the unpaid amount from the date of the default. In addition, the Customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount in question, with a minimum of €25 per invoice.

Without prejudice to the foregoing, Ybe Casteleyn reserves the right to take back items that have not been paid for (in full).

Article 10: Privacy

The data controller, Ybe Casteleyn, respects the Belgian law of December 8, 1992 regarding the protection of private life in the processing of personal data.

The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, processing the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to access and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to Ybe Casteleyn, Meiklokjeslaan 18/2, 1150 Brussels, Belgium. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. To do so, you can always contact Ybe Casteleyn, Meiklokjeslaan 18/2, 1150 Brussels, Belgium.

We treat your data as confidential information and will not transfer, rent or sell it to third parties.

The customer himself is responsible for keeping his login data and password confidential. Your password is stored encrypted, so Ybe Casteleyn has no access to your password.

Ybe Casteleyn keeps online (anonymous) visitor statistics to see which pages of the Internet site are visited to what extent.

Failure at any time by Ybe Casteleyn to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right thereof, shall never be seen as a waiver of such provision and shall never affect the validity of these rights.

Article 14: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to, and the general sales conditions of Ybe Casteleyn. In the event of contradiction, these Terms and Conditions shall prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - disputes

Only Belgian law applies to this agreement, with the exception of the provisions of international private law on applicable law.

The courts of the provider's domicile (Ybe Casteleyn) shall have jurisdiction in all legal disputes.
